For use through link on home page: This document sets forth the terms of use for the international, national and local discussion fora of the Direct Democracy movement's ("DD"s) website www.directdemocracy.org (“site”). Please read the following terms of use (“terms of use”) carefully. By using the site, you, the user (“you”) indicate that you have read and agreed to be bound by these terms of use. If you do not agree to these terms of use, please do not use the site.

The Site is provided as a service of the Direct Democracy movement. The purpose of the fora is to facilitate and simplify discussion and information exchange among Site users in order to promote the objects of DD. DD accepts no responsibility for the opinions and information posted to the fora by others. DD disclaims all warranties with regard to information posted on this site, whether posted by DD or any third party; this disclaimer includes all implied warranties of merchantability and fitness. In no event shall DD be liable for any special, indirect, consequential, or any other damages whatsoever arising out of or in connection with the use or performance of any information posted to these fora.

The Site, including all content and any modifications thereto, is protected by copyright, trademark, patent, trade secret, and other laws. The Site is the property of DD and/or third party licensors and all right, title and interest in the Site shall remain with DD and/or such third party licensors. Nothing in these Terms of Use transfers any rights to you or any third party except as expressly set forth in these Terms of Use.

A link from the Site to a non-DD website does not mean that DD endorses or is responsible for the content, functioning or use of such website, and you enter any such website at your own risk. It is your responsibility to take precautions to ensure that whatever websites or other online materials that you select for use are free of viruses and other items of a destructive nature.

You will not (i) post on or transmit to the Site any false, defamatory, libelous, obscene, pornographic, profane, harassing, hateful, abusive, threatening, harmful (including without limitation viruses, corrupted files, mailbombs, spam, or any other similar software or programs) or unlawful materials; (ii) modify, copy, distribute, publish, create derivative works from, sell or license any information obtained from the Site, without the prior permission of DD; or (iii) use the Site in any manner that violates any applicable laws or regulations.

DD may change the Site, including these Terms of Use, at any time at its sole judgment and without notice. All Terms of Use changes are effective immediately. Your continued use of the Site following any Terms of Use changes will mean you accept those changes.

DD may terminate or restrict at any time, at its sole judgment, the Site or your use of the Site. You may terminate your use of the Discussion Forum by notifying DD, identified in the confirmation email you received upon signup to the Discussion Forum, to remove you from the Discussion Forum.

In the course of using the Site, you may be required to enter certain information, including without limitation contact information. You represent that to the best of your knowledge all Information you enter is correct, and you agree to promptly update such Information as necessary.

By sending any questions, comments, information, suggestions or other materials, including without limitation postings to the Discussion Fora (collectively, "Posted Material") to DD or through the Site, you grant to DD and to any Site user that has access to such Posted Material under these Terms of Use (each a “Site User”) an irrevocable, unlimited, nonexclusive license to use the Posted Material to the full extent of your rights in and to the Posted Material (“Use Right”).

By placing Posted Material on the Site through the Discussion Fora or otherwise, you represent and warrant that: (i) you have the right to post such Posted Material, and to grant the Use Right to DD and Site Users; (ii) if you are not the owner of such Posted Material, you have included with your posting a clear declaration of any limitations of your rights in and rights to use such Posted Material; (iii) you are not prohibited by law, contractual duty, fiduciary relationship, or otherwise from posting such Posted Material; and (iv) your posting of such Posted Material does not violate the copyright, trade secret, privacy, and/or any other rights of any third party. Do not post any information or other material protected by copyright without the permission of the copyright owner.

Please avoid the following behaviors when participating in DD’ Discussion Fora. DD may terminate or suspend participants who engage in these behaviors:

Challenges or attacks on others.
Postings of commercial messages. The cyberspace term for this activity is spamming. Contact people directly with products and services that you believe would be helpful.
Retransmit posted material from the Discussion Group for commercial gain.
Delete, tamper with or revise any Posted Material.
Users follow the advice or content obtained from the list at their own risk. DD does not actively monitor the site for inappropriate postings and does not undertake editorial control of postings. However, in the event that any inappropriate posting is brought to DD’s attention, DD will take appropriate action.

All Discussion Group users are urged to adopt the following Discussion Forum use practices:

11.1. Unless your identity is otherwise apparent from your posting, include a signature tag on all Posted Material. Include your name, affiliation, location, and e-mail address.
11.2. Assume that the world could see your Posted Material and identify it with you.
11.3. State clearly the specific topic of the Posted Material in the subject line. This allows users to respond more appropriately and allows for automatic message archiving.
11.4. Only send Posted Material to the entire Discussion Forum when the Posted Material contains information relevant to all users. Send messages such as "thanks for the information" or "me, too" to individuals - not to the entire Discussion Forum.

DD is not obligated to monitor your or any other user’s use of the Site; such responsibility rests solely with you. DD reserves the right to monitor your use of the Site and to restrict or terminate your use of the Site for any reason in DD’s sole judgment.

The site, including the discussion group and all posted material, is provided “as is” by DD as a convenience to all users, without representation or warranty of any kind to you or any third party, (i) of informational content or accuracy; (ii) of non-infringement; (iii) that the site will operate error free, or in an uninterrupted fashion; (iv) that any defects or errors in the site will be corrected; or (v) that the site is compatible with any particular hardware or software platform. Efforts by DD to modify the site shall not be deemed a waiver of these limitations.

You will indemnify, defend and hold DD and its activists, employees and agents harmless against any and all claims, losses, liabilities, damages, disputes and attorneys fees (collectively, “Losses”), arising from your use of the Site or your breach of these Terms of Use, including without limitation Losses arising from your posting of and/or use of Posted Material.

These terms of use shall be governed by and construed in accordance with the laws of the country which is dealt with by the national or local discussion forum in question. For the international discussion forum issues the laws of Denmark shall apply. You consent to the exercise of personal jurisdiction by such courts in any such action.
